Rent Agreement in Pakistan: Essential Clauses and Registration in Punjab

A clear rent agreement protects both landlord and tenant. It sets out the rent, the deposit, the duration and the rules for using the property, and it becomes essential evidence if a dispute arises. In Punjab, tenancies are governed by the Punjab Rented Premises Act, 2009, which also provides for the registration of tenancy agreements.

Essential clauses

1. Parties and property

Full names, CNIC numbers and addresses of the landlord and tenant, and an exact description of the property, including address and portion rented.

2. Term of the tenancy

Start date, duration and conditions for renewal.

3. Rent

Monthly rent amount, due date, method of payment and any annual increase.

4. Security deposit and advance

The amount, conditions for deductions and timeline for refund at the end of the tenancy.

5. Utilities and charges

Who pays electricity, gas, water, maintenance and other charges.

6. Use of the property

Whether the property is for residential or commercial use, and any restrictions, such as subletting or alterations.

7. Maintenance and repairs

Which repairs are the landlord’s responsibility and which are the tenant’s.

8. Notice and termination

Notice period required from either side and grounds for termination.

9. Handover and inspection

Condition of the property at the start, inventory of fixtures and the process at the end.

10. Dispute resolution

How disputes will be handled, in line with the applicable rent law.

Execution of the agreement

Rent agreements are commonly executed on stamp paper of the appropriate value, signed by both parties and witnessed. Copies should be kept by both sides.

Registration in Punjab

The Punjab Rented Premises Act, 2009 provides for tenancy agreements to be in writing and for their registration with the Rent Registrar. A properly documented and registered tenancy makes it easier to resolve disputes about rent, eviction and deposits before the Rent Tribunal.

Police verification of tenants

Landlords in Punjab are generally expected to provide tenant information to the local police for verification. This is a separate requirement from the rent agreement and should not be overlooked.

Tax aspects

Rental income must be declared in the landlord’s income tax return. Some tenants, such as companies and certain organisations, are required to deduct withholding tax from rent payments. Landlords who are filers generally face lower withholding than non-filers.

Tips for landlords

  • Verify the tenant’s identity and complete police verification.
  • Record the property’s condition with photographs.
  • Issue receipts for rent and deposits.
  • Declare rental income in your tax return.

Tips for tenants

  • Confirm that the landlord is the owner or authorised to rent the property.
  • Pay rent through traceable methods and keep receipts.
  • Read the termination and deposit clauses carefully.
  • Record existing damage before moving in.

Practical example: a deposit dispute avoided

A family rents a house in Gujrat to a tenant for two years. Their rent agreement records the condition of the house with photographs, lists the fixtures, specifies a security deposit and states that deductions may be made only for damage beyond normal wear and tear, supported by receipts. At the end of the tenancy, the landlord deducts the cost of a broken door with a receipt and refunds the rest within the agreed period. Because the agreement was clear, both sides accept the outcome without argument.

Commercial versus residential tenancies

Commercial tenancies, such as shops and offices, often need additional clauses: permitted business use, signage, opening hours, responsibility for licences, fit-out works, and what happens to improvements at the end of the tenancy. Tenants of commercial premises should also check whether the property’s use is permitted for their business under local rules.

Checklist before signing

  1. Verify ownership documents and the landlord’s CNIC.
  2. Agree rent, increase, deposit and payment method in writing.
  3. Record utilities and their current meter readings.
  4. Photograph the property and list fixtures and furniture.
  5. Agree notice periods and termination conditions.
  6. Execute on the correct stamp paper with witnesses.
  7. Complete registration and police verification as required.

Renewals and rent increases

When a tenancy is renewed, a fresh agreement or a renewal addendum should record the new term and rent. Relying on an expired agreement can create uncertainty about the terms that apply. Annual increases should follow what was agreed and the applicable law.

Expert tips

  • Pay and receive rent through bank transfers to create a clear record.
  • Issue a written receipt for the security deposit.
  • Keep the agreement, receipts and correspondence for the whole tenancy and after it ends.
  • Landlords should declare rental income; tenants who are withholding agents should deduct tax as required.

Key terms explained

  • Tenancy agreement: The written agreement between landlord and tenant.
  • Rent Registrar: The authority with whom tenancy agreements are registered under the Punjab law.
  • Rent Tribunal: The forum that decides rent disputes under the Punjab law.
  • Security deposit: An amount held by the landlord against damage or unpaid dues, refundable as agreed.
  • Police verification: The process of providing tenant details to the local police.
